These terms are the agreement between you and Writing Ladder. They are written to be read, not to be skipped.

Writing Ladder is a product of Tinkerbox LLC, a New Mexico limited liability company ("we", "us"), which provides the website and app at writingladder.com. By using it you accept these terms. If you do not accept them, do not use the service.
You must be at least 13 years old. If you are in the European Economic Area or the United Kingdom, you must be old enough to consent to online services where you live. If you are using it on behalf of an organisation, you confirm you are allowed to accept these terms for them.
Writing Ladder is a timer and progress tracker for writing sessions. It gives you timed sprints, prompts breaks, records what you have written, and moves you up a ladder of session lengths.
It is not medical, psychological or therapeutic advice. The method draws on published research about attention, habit formation and breaks, but the programme as a whole has not been clinically trialled. It is not a treatment for any condition, including ADHD, and it is not a substitute for professional help. If focus difficulties are affecting your life, please speak to a qualified professional.
Anything you write in the app belongs to you. We claim no ownership of it and no licence to use it. We do not read it, publish it, or train anything on it.
The one exception is mechanical: to sync your work between your devices we necessarily transmit and store it for that purpose. The Privacy Policy sets out exactly how.
This one matters, so it is not buried in the disclaimer. The app's writing pad is a sprint pad, not a manuscript vault. Software has bugs, browsers clear their storage, devices are lost, and services go down.
Do not rely on Writing Ladder as the only copy of anything you would be upset to lose. Use "Download .txt" after a session, or the "Download my data" export in Settings, and keep your real manuscript somewhere built to hold it.
An account is optional. If you create one, you are responsible for the email address you sign in with and for anything done through your account. Tell us if you think someone else has access to it.
You can stop using the service whenever you like. To delete your account and the data synced to it, use the contact form.

We may suspend or close an account that does these things. Where it is reasonable to do so, we will tell you why first.
Writing Ladder is currently free to use. We do not take payment details and we are not charging anyone. The prices shown on the site describe the plans we intend to offer.
If we introduce paid plans, we will tell you in advance and you will have to actively choose to subscribe. No existing user will be charged automatically or lose access to their history because a paywall appeared. Once billing exists, this section will be replaced with real subscription, renewal and refund terms.
We may add, change or remove features. If we are going to remove something you rely on, or shut the service down entirely, we will give you reasonable notice and time to export your data.
We work to keep Writing Ladder accurate and available, but we cannot promise it will be uninterrupted, error-free, or that it will produce any particular result for your writing or your ability to focus. To the fullest extent the law allows, the service is provided "as is" and we disclaim all implied warranties, including fitness for a particular purpose.
To the fullest extent the law allows, we are not liable for indirect or consequential losses, for lost profits or opportunities, or for lost or corrupted writing. Our total liability to you is limited to the greater of the amount you have paid us in the previous twelve months, or one hundred US dollars.
Nothing here limits liability that cannot legally be limited. If you are a consumer, you keep every right your local law gives you, and nothing in these terms takes those away.
You may stop using the service at any time. We may end your access if you materially break these terms. Sections 4, 5, 10, 11 and 13 continue to apply afterwards.
These terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory laws of your own country.
If we change these terms materially, we will update the date at the top and tell you in the app before the change takes effect. Continuing to use the service after that means you accept the new terms.
